DIGITAL NOMAD VISA | Translation Below

Some days ago the Spanish Government announced the creation of this special Visa. In order to understand this proposal, it is neccesary to explain what a “digital nomad” is.

 

A digital nomad is a person who works remotely taking advantage of new technologies while traveling around the world. In other words, a digital nomad works remotely, regularly changes workplaces and often follows their own schedules.   

 

Therefore, we are usually talking about freelancers who need to be connected to the internet and travel around the world.  

 

This situation has been very common for years. Most frecuent jobs in this kind of environment are: Bloggers, Virtual Assistants, Graphic Designers, Web Developers, Photographers, Online Language Teachers, ...  

 

In practice, digital nomads visit the countries where they have to work through Tourist Visas. However, this authorization does not have the necessary legal coverage to work, because it is exclusively for "Tourist" reasons.  

 

Therefore, since 2018 there is a debate about creating a new type of Visa that would allow digital nomads to have this freedom of movement to develop their work without being subject to the restrictions of any Tourist Visa (stay of 90 days within a period of 180 days). 

 

Although Spain is postulated as the first European country to develop this new Visa, the reality is that there is still no consensus to adapt the immigration regulations to this new labor reality as it has very deep implications in many other facets such as, International Tax Law, Labor Law and Social Security Obligations.

 

That’s why we still do not know what the are possible requirements, documentation, applicable procedure, validity of the visa, etc... will be.

 

We hope that this new Visa will come to light as soon as possible. We think it will attract foreign talent that  will enhance digital jobs and it will expand the range of possibilities to undertake an economic project.

VISA PARA NóMADAS DIGITALES

 

En los últimos dias el Gobierno de España anunció la creación de este Visado especial. Para poder entender esta propuesta corresponde explicar qué se entiende por nómada digital.

 

Un nómada digital es una persona que trabaja en remoto aprovechando las nuevas tecnologías mientras viaja por el mundo. Es decir, un nómada digital trabaja a distancia, cambia habitualmente de lugar de trabajo y, a menudo, sigue sus propios horarios. 

 

Por tanto, hablamos normalmente de trabajadores autónomos que necesitan estar conectados a internet y viajar por todo el mundo.

 

Desde hace años es muy frecuente esta situación. Los empleos más habituales que engloban este novedoso concepto son: Blogger, Asistente Virtual, Diseñador Gráfico, Desarrollador Web, Fotógrafos, Profesor de Idiomas Online, entre otros…

 

En la práctica los nómadas digitales visitan los países donde tienen que trabajar mediante Visados de Turista. Sin embargo, esta autorización no tiene la cobertura necesaria para trabajar, sino como su propia denominación indica, es exclusivamente por motivos “Turísticos”.

 

Por ello, desde el año 2018 se comenzó a hablar de la creación de un tipo de Visado que permitiera a los nómadas digitales tener libertad de circulación para desarrollar su trabajo sin estar sujetos a las restricciones del Visado de Turista (estancia de 90 días en un periodo de 180 días).

 

Aunque España se postula como el primer país europeo en desarrollar este nuevo Visado, la realidad es que todavía no hay un consenso que permita adecuar la normativa de extranjería a esta nueva realidad laboral ya que tiene implicaciones en muchas otras facetas como son, entre otras, el Derecho Fiscal Internacional, Derecho Laboral y las Obligaciones para con la Seguridad Social. Por tanto, todavía desconocemos cuáles serán los posibles requisitos, documentación, procedimiento aplicable, vigencia del visado, etc…

 

Esperamos que este nuevo Visado salga a la luz lo antes posible y con ello atraer a talento extranjero que potencie los empleos digitales y amplíe el abanico de posibilidades para emprender un proyecto económico.
